Terms of Service

These Terms of Service ("Terms") govern your use of Barsity. By creating an account or using the app, you agree to these Terms. If you don't agree, don't use the app.

Barsity is operated by Clint Murray as an individual developer ("we," "us," or "the developer"). Questions about these Terms can be sent to barsitycontact@gmail.com.

Eligibility

To use Barsity, you must:

• Be at least 17 years of age (per the app's age rating on the App Store).
• Be of legal age to enter the venues displayed in your jurisdiction (typically 21 for bars in the United States).
• Have a working phone number capable of receiving SMS messages.
• Provide accurate information when creating your account.

If you are under the age required by law to drink alcohol in your jurisdiction, you may still use Barsity to discover venues, but you must not enter venues you are not legally permitted to enter.

Your Account

You are responsible for your account, including:

• Keeping your phone secure (Barsity uses phone-based authentication; whoever holds your unlocked phone can access your account).
• The accuracy of information you provide (username, name, profile).
• All activity that happens under your account.

You may not create accounts for other people, share your account, or impersonate others. We may terminate accounts found to violate these rules.

Acceptable Use

When using Barsity, you agree not to:

• Harass, stalk, threaten, or impersonate other users.
• Submit false check-ins to manipulate venue rankings or your stats.
• Post fake, misleading, defamatory, or harassing reviews about venues, businesses, or people.
• Use the app to coordinate illegal activity.
• Attempt to access other users' data or our backend systems without authorization.
• Scrape, reverse-engineer, decompile, or otherwise interfere with the app.
• Submit content that is illegal, offensive, infringing, or contains malware.
• Use automated tools (bots, scripts) to interact with the app.
• Spam, send unsolicited messages, or otherwise abuse the friend-request system.
• Circumvent rate limits, GPS verification, or any other security measures.

Violations may result in immediate account termination without notice.

Venues and Third Parties

Barsity displays information about bars, restaurants, and other venues:

• We are not affiliated with, endorsed by, or partnered with any venue shown in the app unless explicitly stated.
• Venue logos, names, and trademarks are the property of their respective owners and are used for identification purposes only.
• We do not verify hours, prices, capacity, age requirements, or other information about venues. Check with the venue directly before visiting.
• We are not responsible for what happens at venues you visit, including but not limited to refused entry, injuries, disputes with staff or other patrons, or any other incidents.

If you are a venue owner and want your venue removed from Barsity, email barsitycontact@gmail.com.

Real-World Safety

Barsity is a tool to help you find venues and coordinate plans — it is not a substitute for personal judgment. You are solely responsible for your own safety and the consequences of your decisions, including:

• Drinking responsibly. Know your limits. Drink water. Eat something.
• Never drink and drive. Use a designated driver, rideshare, or public transit.
• Watch your drink. Don't leave drinks unattended.
• Travel safely. Don't walk home alone if you're impaired or in an unfamiliar area.
• Respect venue rules. Follow staff instructions and venue policies.
• Respect local laws about drinking, public intoxication, and noise.

If you or someone you know is in immediate danger, call 911 (or your local emergency number) — not us.

Content You Submit

You retain ownership of content you submit (username, display name, profile information, and venue reviews). By submitting content to Barsity, you grant us a non-exclusive, royalty-free license to use it for the purposes of operating the app (displaying your name to friends, showing your check-ins, publishing your reviews to other users, etc.).

We may remove content that violates these Terms or that we believe could harm the community.

User-Submitted Venue Reviews

Barsity lets you post short (up to 120 character) reviews about venues you've checked in to. Reviews appear publicly to all Barsity users viewing the same venue, tagged with your username, until they expire at 10 AM the following day.

By posting a review, you agree that:

• You will not post content that is illegal, defamatory, harassing, discriminatory, sexually explicit, threatening, or that violates other people's privacy or rights.
• You will not impersonate other people or businesses, or post commercial spam, promotions, or advertisements.
• You will not post content promoting underage drinking, drunk driving, drug use, or other illegal activity.
• You will not use reviews to harass or defame venues, their staff, or their patrons.
• You are solely responsible for the content of your reviews and any consequences that result.
• Reviews you post are visible to other users and may be viewed, shared, or acted on by them.

We may remove any review at any time, without notice, for any reason, including if we believe it violates these Terms.

Reporting Abusive Reviews

If you see a review that violates these Terms, tap the three-dot menu on the review and select Report. Reports are reviewed by us and acted on within 24 to 48 hours. Reported reviews are automatically hidden from your view immediately upon reporting.

Users who repeatedly post content that violates these Terms may have their accounts warned, suspended, or terminated at our discretion.

Not Endorsed by Us

Reviews are the opinions of individual users. We do not endorse, verify, or take responsibility for the accuracy of any user-submitted review. We are not liable for statements users make about venues, other users, or third parties.

Intellectual Property

The Barsity name, logo, code, design, and all other elements of the app are the property of the developer. You may not:

• Copy, modify, or create derivative works of the app.
• Use the Barsity name or logo for your own purposes.
• Distribute or sublicense any part of the app.

You may share screenshots of your own activity for personal, non-commercial purposes (showing friends, posting to social media).

Service Availability

Barsity is provided "as is." We make no guarantees about:

• Uptime or availability.
• Speed or performance.
• Accuracy of venue information, check-in counts, or other data shown in the app.
• Compatibility with future iOS versions or devices.

The app may be offline, slow, or buggy at times, especially during beta. We may add features, remove features, or shut down the service entirely at any time, with or without notice.

Account Termination

By You

You can delete your account at any time through the app: Account → Edit Profile → Delete my account. Deletion is permanent.

By Us

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraud, or otherwise acted in a way that harms the service or other users. In most cases we'll attempt to give you notice, but in serious cases we may act without warning.

Upon termination, your right to use the app immediately ends. Sections of these Terms that by their nature should survive (Intellectual Property, Disclaimer of Warranties, Limitation of Liability, etc.) continue to apply.

Disclaimer of Warranties

BARSITY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties to the maximum extent permitted by law, including but not limited to: warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of data.

We do not warrant that the app will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy of any information about venues, including hours, prices, capacity, age requirements, or whether they are open.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to: loss of profits, loss of data, personal injury, property damage, or any other intangible losses, arising out of or related to your use of the app — whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability will be limited to the maximum extent permitted by law.

Barsity is operated by an individual developer, not a corporation. Our total liability under these Terms is limited to $100 USD or the amount you paid us in the past 12 months (which is $0, because Barsity is free), whichever is greater.

Indemnification

You agree to indemnify and hold the developer harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of:

• Your use of the app.
• Your violation of these Terms.
• Your violation of any third-party rights (including venue owners, other users, or anyone else).
• Your actions or behavior in the real world while using Barsity.

Changes to These Terms

We may update these Terms as Barsity evolves. When we do:

• We will update the "Last Updated" date at the top.
• Material changes will be communicated via in-app notification before they take effect.
• Continued use of the app after changes means you accept the updated Terms.

If you don't agree to a change, your only remedy is to stop using the app and delete your account.

Governing Law and Disputes

These Terms are governed by the laws of the United States and the state where the developer resides, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the app will be resolved in the state or federal courts of the state where the developer resides.

You and the developer agree to attempt to resolve any dispute informally before filing legal action. Send your concern in writing to barsitycontact@gmail.com and we'll make a good-faith effort to resolve it.

Miscellaneous

• If any provision of these Terms is found unenforceable, the rest of these Terms remain in effect.
• Our failure to enforce any provision is not a waiver of that provision.
• These Terms (together with the Privacy Policy) are the entire agreement between you and us regarding the app.
• You may not assign these Terms to anyone else; we may assign these Terms to a successor entity (e.g., if Barsity is acquired).
